Tensions In DRC As Tshisekedi Gov’t Moves To Prosecute Ex President Kabila For Treason & War Crimes

In a seismic development that could reshape the Democratic Republic of Congo’s political landscape, the country’s Senate has voted overwhelmingly to strip former President Joseph Kabila of his immunity, paving the way for potential prosecution on grave charges, including treason and war crimes.

The motion, passed on Thursday, saw nearly 90 senators vote in favor of lifting Kabila’s legal protections, with only five dissenting. The vote follows months of escalating pressure from authorities who have accused the former head of state of involvement in destabilizing the country’s volatile eastern region.

According to government sources, investigators have compiled a “substantial body of evidence” allegedly linking Kabila, 53, to the M23 rebel group, an armed faction that has seized control of multiple towns in the mineral-rich eastern provinces. Officials claim the evidence includes internal documents, financial records, intercepted communications, and eyewitness testimonies purportedly connecting Kabila to the insurgents’ planning, funding, and operations.

Kabila, who served as president from 2001 to 2019, has not publicly responded to the Senate decision or the latest allegations. However, he has consistently denied any association with M23, a group that has long been accused of committing atrocities and destabilizing peace efforts in the region.

The M23 rebellion—named after a March 23, 2009 peace agreement that the group accuses the government of failing to honor—has resurged in recent years, leading to renewed violence, civilian displacement, and regional instability. The group has been blamed for attacks on civilian populations, use of child soldiers, and resource exploitation.

The lifting of Kabila’s immunity is being seen as an unprecedented move in Congolese politics, given his enduring influence over both the security establishment and key political factions even after leaving office. Critics and supporters alike are watching closely to see whether the decision marks a genuine shift toward accountability or signals deeper power realignments within the ruling elite.

Legal experts suggest that Kabila could now face investigation and potential charges under both Congolese criminal law and international legal frameworks, depending on the findings of further judicial review. Human rights advocates have cautiously welcomed the Senate’s decision, calling for transparency and due process.

“This is a historic opportunity for justice and the rule of law to take precedence over impunity,” said Jean-Baptiste Mbaya, a lawyer and political analyst in Kinshasa. “But it must be handled with fairness, not political vendetta.”

The former president, who inherited power following the assassination of his father Laurent-Désiré Kabila in 2001, remained in office until Félix Tshisekedi assumed the presidency in 2019 following a disputed electoral process. Despite leaving office, Joseph Kabila retained a strong foothold through the Common Front for Congo (FCC) political coalition, which until recently held a majority in parliament.

As the DRC braces for the potential legal battle ahead, regional observers are closely monitoring the implications this may have on national unity, international relations, and future electoral processes.

No formal charges have yet been announced, but judicial authorities are expected to begin preliminary proceedings in the coming weeks.
